Court denies pornographer’s appeal

The Alabama Court of Criminal Appeals Friday refused to reconsider the latest appeal of a former Rainsville skating rink owner convicted of producing pornographic videotapes of boys.

David Lawrence Poole, 55, was charged in August 1989 after police received complaints of a hidden camera in the Rainsville Skate Center bathroom, which Poole owned and operated. Police, at the time, said they found 91 pornographic videotapes in his nearby trailer and home.

The court did not issue a written opinion Friday in denying Poole a rehearing. The court in January 1992 rejected claims by the defense that Poole was prosecuted in violation of search warrant law and that the indictment was flawed.

Poole was charged after a video camera was found in the ceiling of the men’s room at the skating rink. A cable was found leading from the camera to Poole’s trailer next to the center.

He was convicted in DeKalb County Circuit Court in 1990 and sentenced to four consecutive life terms on four counts of producing obscene matter depicting persons under 17 years of age involved in obscene acts. Poole later pleaded guilty to a fifth count.

Poole escaped while being transferred in June 1990, but was found a day later at an Attalla motel.
